Kaltura Connect Terms and Conditions
The following terms and conditions (“Terms”) apply to your registration, attendance, and participation in Kaltura Connect 2020 (“Kaltura Connect”). For the purposes of these Terms, “Attendee” shall mean all participants at Kaltura Connect, including attendees, speakers, and sponsors. Please read these Terms carefully prior to your registration. By registering for Kaltura Connect, you acknowledge and accept these Terms.
General. Kaltura Connect is organized by Kaltura, Inc. (“Kaltura”). Kaltura reserves the right, in its sole discretion, to limit or deny any entity or individual access to the event. Attendees must be 21 years old or older to participate. Kaltura Connect is open only to registered Attendees and is not open to the general public. If you have a disability and require special assistance, please contact Kaltura via email at Connect2020@kaltura.com by December 13, 2019.
Payment, Cancellation, and Refunds. Payment in full for your registration must be made before your registration can be completed. After making payment and completing your registration, you will receive a confirmation email containing your registration details. If you need to cancel your registration, you must submit your cancellation via email to Connect2020@kaltura.com. Cancellations received via email on or before December 6, 2019 will be eligible for a full refund of registration fees.
After December 6, 2019, any cancellations received will not be eligible for a refund. However, if you find that you are unable to attend the event, you may nominate a substitute Attendee to take your place. Substitutions may be made at any time up to the event start date. Please submit any substitution requests via email to Connect2020@kaltura.com.
Kaltura assumes no responsibility for any personal expenses (including but not limited to travel and hotel expenses) that you may incur in connection with your cancellation.
Force Majeure and Cancellation by Kaltura. Kaltura reserves the right to cancel, re-name, or re-locate the event or change the dates on which the event is held. If Kaltura cancels the event due to circumstances beyond its reasonable control (such as acts of God, acts of war, acts of terrorism, governmental emergency, labor strike, or unavailability of the event venue), Kaltura shall provide a full refund of registration fees to registered Attendees.
Kaltura uses the personal information that you provide during registration to manage your participation in Kaltura Connect. This may include contacting you with information about Kaltura Connect event logistics, content, payment, changes, and other updates. In addition, by submitting your email address during the registration process, you agree that Kaltura and the Kaltura Connect sponsors may send you event-related communications. A valid email address is required for all Kaltura Connect registrations.
Kaltura may disclose your personal information to third-party service providers engaged to provide assistance in organizing and hosting the event (including but not limited to the event venue, the registration management service provider, and the event mobile application provider). Except as described in this section, Kaltura will not share your personal information with any other third party unless required to do so by applicable law.
Multimedia Policy. To comply with global privacy laws, Kaltura imposes certain restrictions on the use of multimedia (e.g. photography, video, audio, online streaming, and all future mediums) at Kaltura Connect. Attendees are permitted to use smart phones or other mobile devices to take photographs for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, distributed, or otherwise commercially exploited in any manner whatsoever.
Kaltura may engage one or more third-party service providers (photo, video, streaming, and/or audio) to document and display event activities. Kaltura may also post real-time photos and videos from Kaltura Connect to its social media feeds. Attendees are welcome to capture their own experience at the event and share such content on their social media accounts, provided the content does not defame any other Attendee or infringe upon any third party’s intellectual property rights.
By attending Kaltura Connect, you acknowledge and agree as follows: (a) Kaltura may edit the footage it captures at the event for marketing and promotional purposes and for any other lawful purpose in the ordinary course of its business; and (b) due to the prevalence of mobile recording devices, Kaltura disclaims all liability for the capture of your image in multimedia format by any other Attendee.
Kaltura Connect Badge Policy. Event badges will be issued to each Kaltura Connect Attendee. Only the Attendee named in the registration may pick up and use his/her badge. A photo ID may be required to confirm the Attendee’s identity when collecting a badge at the event. Attendees may not share badges. Badges must be worn at all times during Kaltura Connect. Kaltura uses badge scanning to determine attendance and manage event capacity.
Guest Speakers. Kaltura may invite guest speakers from various industries to share their perspectives on relevant topics. Guest speakers are not Kaltura employees or representatives. Guest speaker views and opinions are entirely their own and do not necessarily reflect Kaltura’s views and opinions.
Liability Waiver and Release. In consideration for your registration and participation in Kaltura Connect, you hereby represent and warrant that you are age 21 or above and freely waive, release and discharge Kaltura and its personnel from any and all liability for loss of life, disability, personal injury, property damage, property theft, or actions of any kind that you may hereafter suffer before, during, or after the event unless such loss or injury is caused solely by Kaltura’s gross negligence. This liability waiver and release is specifically binding on your heirs and assigns and is knowingly given.
Kaltura Connect Code of Conduct. To help create a safe, productive, and welcoming Kaltura Connect experience for everyone, Kaltura requests that all Attendees comply with the following Code of Conduct.
All Attendees shall:
- Be respectful and considerate towards everyone you engage with at Kaltura Connect;
- Keep your belongings secure, and be mindful of your surroundings and your fellow Attendees; and
- Keep messages informative, useful, and relevant to the event when interacting with Attendees via the Kaltura Connect mobile application.
Attendees shall not:
- Harass, abuse, demean, or threaten those you engage with at Kaltura Connect or express hatred towards any person for any reason;
- Use the Kaltura Connect mobile application for commercial or advertising purposes or to spam other Attendees;
- Use the Kaltura Connect mobile application to post or share content that is defamatory or obscene, or that infringes on a third party’s intellectual property rights; or
- Engage in harmful or criminal conduct of any kind.
Reporting Code of Conduct Violations. If you have been (or notice that someone else has been) impacted by an Attendee failing to adhere to the Code of Conduct or otherwise have concerns about inappropriate or prohibited behavior, please contact a member of the Kaltura onsite team or by emailing Connect2020@kaltura.com. In the event of an emergency, please contact local authorities immediately.
Consequences of Violating the Code of Conduct. Unacceptable behavior will not be tolerated at Kaltura Connect. If you violate the Code of Conduct, Kaltura reserves the right to cancel your Kaltura Connect registration without warning or refund and escort you from the event premises. You may also be prohibited from registering for or attending future Kaltura events.
Updates to these Terms. Kaltura reserves the right to modify these Terms at any time and without prior notice. If one or more provisions of these Terms are deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to be valid and apply to your participation in Kaltura Connect.
